Copyright Protection in India
Copyright protects original literary, artistic, musical, and dramatic works — including software and databases. Protection arises automatically on creation, though registration strengthens enforcement rights.
Overview
Under the Copyright Act, 1957, copyright subsists automatically in original works from the moment of creation — there is no requirement to register or use a © symbol, though both are advisable. The term of copyright for most works is the life of the author plus 60 years.
Registration is voluntary but creates a public record and significantly strengthens the position in infringement proceedings. We advise on copyright ownership and authorship issues (which are frequently more complex than clients expect), registration, licensing, and enforcement across all categories of creative and technical works.
For technology companies in particular, copyright is often the primary IP asset. Source code, user interfaces, databases, and content are all potentially protectable — but ownership arrangements in commissioned work or employment situations require careful documentation to avoid disputes.
